The Supreme Court on Tuesday dismissed a certiorari application filed by Kwame Adofo, the former legal counsel for the Komfo Anokye Teaching Hospital (KATH) in Kumasi. The court also imposed a penalty of GH¢20,000 on Adofo for filing what it deemed a frivolous and time-wasting application.
While still serving as KATH’s legal representative, Adofo reportedly launched a series of personal attacks against the hospital and its Chief Executive Officer (CEO). This led the hospital’s management to report his alleged unprofessional conduct to the General Legal Council, seeking an investigation and appropriate sanctions.
Despite the ongoing inquiry, Adofo continued to disparage both KATH and its CEO, further complicating matters by releasing confidential information about the hospital. This breach occurred despite his contractual obligation to protect the institution’s interests as its legal counsel.
In response to these actions, KATH decided to sue Adofo in the High Court, seeking damages for breaching his duty to safeguard confidential information obtained during his tenure as the hospital’s lawyer.
Instead of presenting a defense to the High Court, Adofo argued that the court had no jurisdiction over the matter, claiming his conduct was already under review by the General Legal Council. The High Court rejected this argument, imposed a cost on Adofo, and proceeded with the case.
Undeterred, Adofo escalated the matter to the Supreme Court, but the court dismissed his application as baseless and a misuse of legal resources.
