The 2027 United States Diversity Visa (DV) Lottery, popularly known as the Green Card Lottery, remains on hold after the U.S. Court of Appeals for the Ninth Circuit blocked a lower court order directing the government to reopen registration by November 1, 2026.
The latest development has created uncertainty for thousands of prospective immigrants worldwide, including many Ghanaians hoping to secure permanent residency in the United States.
The suspension is part of the Trump administration’s broader immigration policy, which has seen increased scrutiny of legal immigration programmes and security screening procedures.
The U.S. Department of State, under Secretary of State Marco Rubio, initially delayed the DV-2027 registration process following security concerns and a review of the programme’s vetting procedures.
U.S. President Donald Trump has been a prominent critic of the Diversity Visa programme, including during his first term in office.
His administration’s decision to suspend the programme followed the December 2025 shootings at Brown University and the Massachusetts Institute of Technology (MIT), involving a Portuguese suspect who had entered the United States through the Diversity Immigrant Visa programme.
Following the identification of the suspect, Homeland Security Secretary Kristi Noem announced that she was suspending the programme, arguing that the alleged shooter should never have been allowed into the country.
The move formed part of the Trump administration’s broader efforts to tighten immigration controls and reassess security screening procedures for foreign nationals entering or residing in the United States.
Trump had previously criticised the Diversity Visa programme, arguing during his first presidency that it allowed people into the country without sufficient consideration of their qualifications.
Secretary of State Marco Rubio also defended the decision to suspend the programme, explaining that the government wanted to review whether its existing vetting procedures were sufficient.
The administration’s position has generated debate over the future of the lottery, particularly among immigration advocates who argue that individual criminal incidents should not be used to restrict opportunities for eligible applicants from other countries.
How the DV-2027 registration delay started.
Following the security concerns, the U.S. Department of State paused preparations for the DV-2027 programme and delayed its usual autumn registration period.
The decision prevented prospective applicants from submitting their entries during the expected registration period, raising concerns among individuals who had been preparing to participate in the annual lottery.
The Diversity Visa programme provides up to 55,000 immigrant visas annually to eligible individuals from countries with historically low rates of immigration to the United States.
Successful applicants may qualify for lawful permanent residency, commonly known as a Green Card, which allows them to live and work permanently in the country.
Court orders U.S. government to reopen registration.
The suspension later became the subject of a legal challenge after Red Eagle Law, L.C. filed a case against the government over its failure to open registration.
On October 14, 2026, U.S. District Judge Jinsook Ohta ruled in Red Eagle Law, L.C. v. Rubio that the government’s failure to commence the DV-2027 registration process was arbitrary.
The judge subsequently ordered the government to announce registration details by October 29 and open the application process by November 1, 2026.
The ruling initially raised hopes among prospective applicants that the delayed programme would finally reopen.
However, the U.S. Department of State challenged the decision and requested an emergency stay from the Ninth Circuit Court of Appeals.
Ninth Circuit blocks November 1 registration deadline.
On October 29, 2026, the Ninth Circuit Court of Appeals granted the government’s request for an emergency stay, blocking the lower court’s order to reopen registration.
In its decision, the appellate court found that the plaintiff law firm had not established the necessary legal standing and zone of interests to obtain a preliminary injunction.
The court explained that the Diversity Visa programme was established to encourage immigration from countries with historically low immigration rates to the United States, rather than to generate revenue for law firms.
Importantly, the appellate court clarified that its decision did not endorse the Department of State’s failure to open the lottery registration period.
Nevertheless, the emergency stay means the government is no longer under an enforceable court order to begin registration on November 1.
The DV-2027 programme therefore remains on hold while the legal proceedings continue.
What this means for Ghanaians and other applicants.
The latest development means Ghanaians and other prospective applicants hoping to participate in the DV-2027 lottery will have to wait for further announcements from the U.S. Department of State.
Applicants should not assume that registration has opened simply because November 1 was previously announced as the deadline in the lower court’s ruling.
They are also advised to prepare their relevant personal information and educational documents while waiting for official updates.
It is important to note that entering the Diversity Visa Lottery does not automatically guarantee selection or the issuance of a U.S. visa. Selected applicants must still meet the eligibility requirements and complete the necessary immigration procedures.
DV-2026 Green Card Lottery officially expires.
Meanwhile, the previous Diversity Visa programme, DV-2026, officially expired on September 30, 2026.
This means applicants selected under the DV-2026 programme who did not receive their immigrant visas before the end of the 2026 fiscal year are no longer eligible to obtain visas through that particular cycle.
The expiration has added to the concerns of prospective immigrants who were hoping to participate in the delayed DV-2027 programme.
Applicants warned against Green Card Lottery scams.
With the DV-2027 registration still on hold, prospective applicants have been cautioned against fraudulent websites, individuals and agencies claiming to offer registration services.
Scammers may take advantage of the uncertainty by advertising fake registration dates, requesting payments or promising applicants guaranteed selection.
Applicants are therefore encouraged to rely on official announcements from the U.S. Department of State and avoid sharing personal information with unverified individuals or platforms.
DV-2027 registration: What happens next?.
The next steps will depend on further developments in the ongoing legal proceedings and announcements from the U.S. Department of State.
For now, there is no enforceable November 1 court deadline requiring the government to open registration.
Although the Trump administration’s suspension has raised questions about the future of the Diversity Visa programme, the latest appellate court decision does not amount to a final ruling permanently abolishing the lottery.
For thousands of people around the world, including hopeful applicants in Ghana, the wait for an opportunity to participate in the U.S. Green Card Lottery continues.
ANCempire radio will continue to follow developments surrounding the DV-2027 programme and provide updates as further information becomes available.
